I’m about to lose my grandchildren to foster mom who want to adopt.?
My daughter had her parental rights severed. Appropriately so, and put into foster care without our knowledge when we found out we tried Asking AZ CPS how can we adopt them they never returned our calls. We finally contacted an Attorney and have gone to Court two times. Each time the Judge called for a review in six months. Cps has made up lies about us. Now my Attorney says that he does not think we can win case because of a ruling from the Appeals case which states that if CPS does not fell that Grandparents should not get the children basically that it. Does anyone else know where I can get help. We are decent people we do not want to lose our grandchildren. Time is of the essence My Attorney says that there will be a telephone conference between the Attorneys and the Judge coming up soon even though we are schedule to go to Court July 31, 2008. I’m afraid the judge will make a decision before that court date.
You need a new attorney first of all. Secondly you can sue CPS. YOu have kinship rights, and, in NY at least, people with kinship rights have first dibs (for lack of a better expression) on the kids. If they deny you without fair process, they are violating your rights and those of the children. I guarantee you its in their policy that it is in the best interest of the children to stay within the family, and be adopted by their grandparents.
I don’t think the judge can issue a decision before the court date however, but you are correct expediting the process. Get a new lawyer, and petition the court. Also, file suit against CPS for violating your kinship rights. That will wake them up.
